A petition must be filed to begin a case in tax court. By statute, you have a limited amount of time to file this petition after receiving the results of an audit. No extensions are available. We will make certain that the petition is filed in a timely manner.
Cases are scheduled for trial as soon as possible. Leading up to the trial, our lawyers will not only prepare your case, but attempt to negotiate a resolution with the tax authority. Most cases are actually settled prior to trial, and we have achieved a great deal of success getting reduced tax bills through pretrial negotiation in tax court cases.
If the case does go to trial, the trial will be overseen by one judge. There is no jury in a tax court case. Tax court judges are experts in tax codes and tax law, and committed to seeing that tax assessments are fair. During the trial, we will have the opportunity to present evidence, including documentation regarding your taxes. We will argue for a reduction of your tax bill. The judge will issue his or her opinion and the case will be closed.
Our goal is a positive outcome in tax court, but there may be additional appellate remedies available if the outcome is not satisfactory.
In some cases, when the tax bill is $50,000 or less, the case may be resolved through the United States Tax Court’s simplified small tax case process. This process is less formal and allows for a faster outcome. However, decisions issued in this process cannot be appealed. If this is the right option for you, we will recommend it and help you move forward.
